"text": "Conflict of Laws issues on Virtual Assets in an Aspect of Financial Transactions presents the following source proposition: 앞서 금융시장 국제화에 따른 변화를 ‘외국적 요소’의 등장이라고 한다면 새로운 변화는 금융거래에 있어 ‘가상적 요소’(virtual element)의 출현이라고 할 수 있을 것이다.
본 연구에서는 이러한 최근의 변화가 금융법과 국제사법에 있어 어떤 쟁점을 새로이 제기할 것인가를 살피고, 기존의 국제금융거래에 있어 준거법의 결정, 재판관할과 외국판결의 승인 등에 대한 국제사법의 연구결과가 ‘가상자산을 통한 금융거래’에 있어서도 그대로 적용될 수 있는지, 어떤 변용이 필요한지에 대해서 연구하였다, 이를 위해 가상자산의 등장과 우리나라에서의 논의 전개에 대해 살펴보고, 가상자산을 통한 금융거래를 금융거래의 대상으로서 가상자산의 문제, 금융거래의 주체로서의 탈중앙화자율조직(DAO, Decentralized Autonomous Organization)의 문제, 금융거래의 방식으로서 스마트 계약(smart contract)의 문제로 나누어 각각 법적 논의를 정리하고, 국제사법적 쟁점에 대해 검토하였다.
가상자산을 통한 금융거래는 아직 완성형이라기보다는 진행형에 가깝고, 현재의 국제사법은 외국적 요소 외 가상적 요소를 고려하여 마련된 것이 아니다.
